My sworn declaration

My name is Ryan Nichols. My date of birth is December 6, 1990. I am the Defendant in this case. I make this declaration under penalty of perjury pursuant to Texas Civil Practice and Remedies Code section 132.001. I make these statements based on personal knowledge unless otherwise stated.

  1. I am currently appearing pro se. I have not knowingly, intelligently, and voluntarily waived counsel.
  2. I am filing these motions because immediate issues affect my liberty, bond conditions, constitutional rights, medical status, public safety, and ability to prepare a defense.
  3. This case arises from an alleged encounter at church.
  4. I deny drawing, brandishing, pointing, pulling, or firing a firearm at anyone at church.
  5. My position is that I did not threaten anyone with a firearm.
  6. My position is that I called law enforcement myself.
  7. I understand that public reporting described the allegation as me raising my shirt and placing my hand on the grip of a firearm.
  8. I believe later public statements escalated beyond that allegation into claims that I pulled, pointed, brandished, or shot a firearm.
  9. I need the bodycam, CAD, dispatch audio, 911 or non-emergency audio, police reports, officer notes, and church camera footage to prove what happened and what witnesses said at the scene.
  10. I also need any public videos, comments, screenshots, posts, or witness-provided materials reviewed by law enforcement or the State.
  11. I have published articles on RealRyanNichols.com documenting my account, public rumors, public threats, and my request for bodycam and source records.
  12. I believe the bodycam and official records will show material inconsistencies in the way the story was told.
  13. I have documented PTSD.
  14. I have physician documentation related to Texas Compassionate Use Program approval.
  15. I may test positive for THC because of lawful medical use.
  16. I am not asking to avoid supervision. I am asking that lawful medical THC use not be treated as unlawful drug use without verification and a hearing.
  17. I believe broad or unclear restrictions on social media and online speech interfere with my work, journalism, evidence preservation, public response to false claims, and defense preparation.
  18. I am not asking for permission to threaten, harass, contact alleged victims, dox anyone, or publish minors' private information.
  19. I am asking for clear, narrow, written conditions so I can comply with the Court's orders and still preserve evidence, work, and defend myself.
  20. I declare under penalty of perjury that the foregoing is true and correct to the best of my personal knowledge.
