Weston Sobotka is a Virginia man who took a single misdemeanor count, served intermittent weekends, and went home. One count. Fifteen days. That is the whole federal case. FACT: Weston Sobotka is from Virginia (Sedition Tracker case file; Insurrection Index). FACT: He was charged with one count, parading, demonstrating or picketing in a Capitol building, 40 U.S.C. 5104(e)(2)(G). A petty misdemeanor. No felony. No assault count (Sedition Tracker). FACT: He was arrested August 17, 2022 and pleaded guilty January 9, 2023 before Judge Carl J. Nichols (Sedition Tracker). FACT: On April 18, 2023 he was sentenced to 15 days intermittent confinement, three years probation, and $500 restitution (Sedition Tracker). THE LEGAL FIGHT Sobotka was not charged until August 2022, more than a year and a half after January 6, 2021. He faced one petty offense, the lowest charge the government brought in these cases. He pleaded, he served intermittent confinement, and he carried probation. FACT: On January 20, 2025 the President issued a proclamation granting clemency in cases relating to the events at or near the United States Capitol on January 6, 2021. WHAT THIS DOES NOT PROVE: a misdemeanor parading count is not a violence finding and was never charged as one. Do not read more into this record than the record says.
