Troy Anthony Smocks is a 58 year old man out of Dallas, Texas, and by the time federal agents came for him he had already spent decades as a grown man watching this country from the outside of the conversations that decide it. Here is what the record shows, plain. Smocks was not charged over anything he did inside the Capitol. His case is built on words he posted online after January 6, 2021, on a message board, threatening language aimed at officers and at tech executives. He pleaded guilty to one count of threats in interstate communications. Sentenced October 21, 2021, to 14 months in federal prison, 36 months of supervised release after that, and a $100 assessment. We are not going to soften what the charge was. Threatening language is a real charge and Smocks admitted to it in open court. That is the record and Ryan Nichols is not in the business of rewriting it. Here is the rest of the record, because it belongs next to that. Smocks did not go quiet after his sentence. He fought back in court against Parler, the platform that banned him, seeking damages he said the company owed him. He has spoken publicly, on video and through supporters, calling himself a political prisoner of the moment, arguing the sentence did not fit posts made in anger. Others who followed his case, including a fellow veteran voice online, have pushed back on how his case and his race were covered in the press. That is their account, not a fact this record can confirm on its own, and we are labeling it that way on purpose. On January 20, 2025, Troy Smocks received a full presidential pardon. THE RECORD Name: Troy Anthony Smocks Hometown: Dallas, Texas Charge: Threats in Interstate Communications Plea: Guilty Sentence: 14 months incarceration; 36 months supervised release; $100 special assessment Clemency: Full pardon, January 20, 2025 Sources: Federal charging document; Washington Post; Dallas Morning News; Gizmodo (Parler suit) What this does not prove: it does not erase the threatening words he admitted posting. What it does prove: he served his sentence, he kept fighting in the courts afterward, and the President of the United States granted him a full pardon. This is the record. The record does not lie, and neither should we about what is in it. This profile is unclaimed. If this is you, or your family, claiming it is free, forever.
