Traci J. Sunstrum is a woman from Amherst, New York, a suburb on the north side of Buffalo. She was 44 years old at the time of her arrest, one of a small handful of Western New York residents charged over January 6. She never went to prison. Not one day. That is worth saying plainly, because the word "January 6 defendant" makes people picture something this record does not support. THE LEGAL FIGHT. FACT: Traci J. Sunstrum was arrested on May 19, 2021, with her initial appearance on May 27, 2021. FACT: her case in the U.S. District Court for the District of Columbia was renumbered from 21-mj-371 to 21-cr-652. FACT: the single charge she was convicted on is Parading, Demonstrating or Picketing in a Capitol Building. A petty offense. FACT: she entered a plea agreement on November 17, 2021 and pleaded guilty. FACT: on February 24, 2022 she was sentenced to three years of probation, 30 days of home detention with location monitoring, a $10 special assessment and $500 in restitution. FACT: federal prosecutors had recommended a 14 day jail sentence and the court did not impose it. She avoided jail entirely. DOCUMENTED INFERENCE: according to court documents, the FBI identified Sunstrum from an anonymous tip about a Facebook livestream, then used a Google location warrant and driver's license comparison to place her inside the building. She is described in filings as wearing a green jacket and stars-and-stripes patterned pants. WHAT THIS DOES NOT PROVE: Traci Sunstrum was never charged with assault, never charged with destruction of property, and never charged with a weapon offense. Parading is parading. Do not let anyone inflate it. FACT: on January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. Traci J. Sunstrum of Amherst, New York received a full pardon.
