Father and son. That is the shape of this case. They were charged together, tried together, and their cases died together. WHAT THE RECORD SHOWS FACT: Toney Bray, 46, and his son Ethan Bray, 25, were first stopped the evening of January 6, 2021 by Metropolitan Police for a curfew violation. That was the whole of it for two and a half years. FACT: Federal authorities arrested the two of them on June 8, 2023. FACT: An FBI affidavit alleged they entered the Capitol around 2:22 p.m., were among the first to breach police barricades at Peace Circle, and confronted officers under the scaffolding at the Lower West Terrace. The affidavit further alleged that Toney Bray carried a Capitol Police riot shield out of the building. Those are the government allegations in the charging affidavit. Attributed, not adopted. THE LEGAL FIGHT FACT: Toney Bray pleaded guilty to three counts. Theft of Government Property. Entering or Remaining in a Restricted Building or Grounds. Parading, Demonstrating, or Picketing in a Capitol Building. FACT: The remaining counts went to a bench trial. On October 3, 2024, the court found him guilty of Civil Disorder and Disorderly and Disruptive Conduct in a Restricted Building or Grounds. FACT: On that same bench trial the court found Toney Sheldon Bray NOT GUILTY of Disorderly Conduct in a Capitol Building. He beat a count. That belongs in the record right next to the rest of it. FACT: Sentencing was set for February 7, 2025. FACT: On January 21, 2025, the court granted the government motion to dismiss the case with prejudice, following the January 20, 2025 clemency proclamation covering the January 6 prosecutions. FACT: Toney Bray was never sentenced. He served no prison term on this case. WHAT THIS DOES NOT PROVE Not one assault count. Not one weapon count. A shield carried out of a building is theft of government property, and that is what the government charged. It is not a firearm and it is not an assault. Do not stretch it. NEEDS AUTHENTICATION We do not have his trade, his service record if he has one, his church, or a word from him in his own voice.
