Thomas Kenny is a Greenwich, Connecticut man who told federal investigators the truth in August 2021, and then waited two and a half years for them to come arrest him for it. He walked in the front. He walked a circle around the Rotunda. He walked out. About thirty minutes, start to finish. WHAT THE RECORD SHOWS FACT: Thomas Kenny and his brother Michael Kenny entered the Capitol through the Upper West Terrace door on January 6, 2021, walked in a circle around the Rotunda, and exited after roughly 30 minutes. FACT: In August 2021, Thomas Kenny admitted to investigators that he had been inside the Capitol with his brother. He said it voluntarily. He said it early. FACT: He was not arrested until December 21, 2023. Two years and four months after he told them. FACT: The government charged him with two misdemeanors. Disorderly Conduct in a Capitol Building or Grounds, and Parading, Demonstrating, or Picketing in a Capitol Building. No felony. No assault count. No weapon count. THE LEGAL FIGHT FACT: Thomas Kenny pleaded guilty to both misdemeanor counts. He faced up to six months and fines up to $5,000. FACT: On January 27, 2025, the court granted the government motion to dismiss the case with prejudice, following the January 20, 2025 clemency proclamation covering the January 6 prosecutions. FACT: Thomas Kenny was never sentenced. He served no time on this case. WHAT THIS DOES NOT PROVE Thirty minutes and a lap around the Rotunda. Nothing in this record charges Thomas Kenny of Greenwich, Connecticut with violence, with breaking anything, or with carrying anything.
