Thomas Hodo
January 6 defendant
Documented editorial-use imageThomas Hodo is a Snohomish, Washington man who waited three and a half years for the knock on the door, faced the charges when they finally came, and walked out the other side with no conviction on his record. That last part is the part that matters. It is also the part that rarely gets printed. HIS STORY Thomas Hodo, 47, of Snohomish, was in the last wave of January 6 defendants ever charged. The FBI arrested him on August 20, 2024 in Phoenix, Arizona, and he made his first appearance in the U.S. District Court for the District of Arizona. [FACT: U.S. Department of Justice.] A member of the Snohomish community told the Snohomish County Tribune that Hodo turned himself in rather than being tracked down. The Tribune updated its story to reflect that account and said it was still working to verify it. [NEEDS AUTHENTICATION: Snohomish County Tribune, September 3, 2024 update.] On January 6, 2021, Hodo and Derek Noftsger, also from the Snohomish area, unfurled a U.S. flag on the Capitol grounds. They were charged as co-defendants. [CHARGE ONLY: DOJ affidavit as reported by the Snohomish County Tribune.] HIS LEGAL FIGHT Hodo was charged by criminal complaint in the U.S. District Court for the District of Columbia with one felony count of civil disorder and three misdemeanor counts: entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, and disorderly conduct in a Capitol building or grounds. [CHARGE ONLY: U.S. Department of Justice.] The supporting FBI affidavit alleged that he helped pull at a bike rack barricade, threw an object toward the police line, and spoke through a megaphone. Those allegations were never tested at trial and were never proven. [CHARGE ONLY: DOJ affidavit as reported by WUSA9 and the Snohomish County Tribune.] Thomas Hodo never went to trial. The records reviewed for this profile show no conviction and no guilty plea. His case was still pending on January 20, 2025, when the presidential clemency proclamation covering January 6 cases issued and the Justice Department began moving to dismiss the cases that remained. [FACT for the proclamation. DOCUMENTED INFERENCE as applied to this case.] Publicly compiled January 6 case trackers report the case was dismissed with prejudice in February 2025. This archive has not read that docket entry directly and will not state it as settled until it has. [NEEDS AUTHENTICATION.] CASE RECORD U.S. District Court for the District of Columbia.
