Terry L. Allen is a Spring Mills, Pennsylvania man in his sixties whose January 6, 2021 case ended with a conviction, a prison sentence, and then a presidential clemency. Let's not soften the record. A federal jury found Allen guilty of assaulting officers with a wooden flagpole and throwing a second, metal flagpole at officers standing nearby, on the west plaza of the Capitol. He was convicted on felony and misdemeanor counts, including civil disorder and assaulting, resisting, or impeding officers with a dangerous weapon. A judge sentenced him to two years in federal prison. That is what a jury found. We are not going to pretend the record says something lighter than it does. Here is what we will not do either: we will not add anything the record doesn't support. No claim of intent beyond what jurors heard. No embellishment of the video evidence prosecutors used. The charges are what they are, and the conviction is what it is. The legal fight and where it stands: Allen was arrested and prosecuted in the U.S. District Court for the District of Columbia. He was convicted following trial and sentenced to two years in prison in late 2024. Then, on January 20, 2025, President Trump issued clemency covering January 6 defendants, and that clemency reaches Terry Allen's case. What this does not prove: it does not change what a jury found happened on the west plaza that day. Clemency is not exoneration, and we label it as clemency, not innocence. What this does prove: due process ran its full course here. Arrest, trial, jury verdict, sentencing, and then a political act of clemency at the end of it. Every step is documented.
