Robert Westbury is a 62-year-old husband and father from Lindstrom, Minnesota, a small Chisago County town an hour north of the Twin Cities. He went to Washington with his son. He came home to a federal case that took more than three years to end. It ended with the government asking a judge to throw it out for good. FACT: He is the husband of Rosemarie Westbury and the father of Isaac Westbury, who was charged alongside him. A third Lindstrom man, Aaron James, was charged in the same case. All three were arrested in Lindstrom on October 4, 2021. FACT: A sitting Minnesota state senator, Mark Koran, publicly vouched for the Westbury family and asked his own supporters to help them, writing: "They are a good family!" THE CHARGES, AND ONLY THE CHARGES CHARGE ONLY: Entering and Remaining in a Restricted Building or Grounds; Disorderly and Disruptive Conduct in a Restricted Building or Grounds; Disorderly Conduct in a Capitol Building; Parading, Demonstrating, or Picketing in a Capitol Building. All four are misdemeanors. FACT: Robert Westbury pleaded NOT GUILTY to every count and never wavered. A jury trial was set for August 4, 2025. HOW IT ENDED FACT: On January 21, 2025, the court granted the government motion to dismiss the case WITH PREJUDICE. Dismissed with prejudice means it is over. The government cannot bring it back. He was never convicted of anything. FACT: On January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. Robert Westbury never served a day of incarceration on this case.
