Nineteen days. He was one of the earliest arrests in the entire investigation, before most of the country had any idea how big this was going to get. FACT: Robert Anthony Lyon was arrested January 25, 2021 and charged in the U.S. District Court for the District of Columbia, case 1:21-cr-161. FACT: he was indicted February 26, 2021 on six counts, including obstruction of an official proceeding and aiding and abetting, theft of government property and aiding and abetting, and four lesser counts. FACT: he was arraigned April 21, 2021 and pleaded not guilty. FACT: on March 14, 2022 Robert Anthony Lyon pleaded guilty to two counts, theft of government property and disorderly conduct in a Capitol building. FACT: on September 22, 2022 he was sentenced to 40 days of incarceration, one year of supervised release, a $1,000 fine, $2,000 in restitution and $100 in special assessments. FACT: in June 2024 the Supreme Court held in Fischer v. United States that the Justice Department had read that statute too broadly against January 6 defendants. DOCUMENTED INFERENCE: Robert Anthony Lyon had already pleaded and been sentenced by then, so that ruling came two years too late to touch his case. CHARGE ONLY: press reporting connected his case to a co-defendant, Dustin Thompson, and to property taken from the Capitol. The January 20, 2025 presidential proclamation granted full pardons for offenses related to the events at the Capitol on January 6, 2021.
