Robert William DeGregoris is a Loudoun County man from Aldie, Virginia. He was 32 years old when he was arrested, a Northern Virginia commuter who rode the Metro into the District like a million other people do. Here is the headline nobody ran: the government dismissed his case with prejudice. Robert William DeGregoris was never sentenced. Not one day of a sentence was ever imposed on him. THE LEGAL FIGHT. FACT: a criminal complaint against DeGregoris was filed January 23, 2023 and he was arrested January 25, 2023. FACT: he was charged in the U.S. District Court for the District of Columbia with Civil Disorder, Entering and Remaining in a Restricted Building or Grounds, Disorderly and Disruptive Conduct in a Restricted Building or Grounds, and Impeding Passage Through the Capitol Grounds or Buildings. FACT: Robert William DeGregoris pleaded NOT GUILTY to all charges. He did not take a plea deal. He went to trial. FACT: a bench trial was held July 8 through July 10, 2024. FACT: the verdict came down October 4, 2024, guilty on all counts. FACT: sentencing was set for February 7, 2025. FACT: on January 21, 2025, before any sentence was imposed, the court granted the government's motion to DISMISS THE CASE WITH PREJUDICE. With prejudice means it cannot be refiled. Ever. DOCUMENTED INFERENCE: court records describe an FBI tip about a social media post and the use of Verizon cell data and a Metro transit card purchase to trace his commute from Virginia into Washington. THEIR ACCOUNT: when agents asked him about the post attributed to him, DeGregoris told them, "I don't know what that is." WHAT THIS DOES NOT PROVE: charging documents said DeGregoris was "possibly striking" a helmet. Possibly is not a finding. He was never charged with assaulting an officer, and no sentence was ever entered against him. FACT: on January 20, 2025, President Trump granted clemency covering the January 6 prosecutions.
