He was never sentenced for any of it. FACT: Michael Sposite of St. Clair, Michigan was arrested on March 5, 2024, more than three years after January 6, 2021. He was indicted on March 27, 2024. FACT, per the charging documents summarized in the NPR January 6 archive: investigators identified Sposite in footage wearing a green jacket, a camouflage hat, and a walkie talkie clipped to his backpack. He was on the Capitol grounds that afternoon with two other men, Clayton Hildebrand and Evan Hunt. Open source video showed the three of them on a ledge chanting USA while protesters and police clashed below. FACT: they went in through the Senate Wing door at about 2:17 p.m. They came back out through the same door three minutes later. Three minutes in. Three years to the arrest. THE LEGAL FIGHT FACT: Michael Sposite pleaded guilty to one charge, parading, demonstrating, or picketing in a Capitol building. It is a petty offense, the lowest thing on the list. FACT: a jury trial was set for April 15, 2025 on the remaining counts, including the felony obstruction count. That trial never happened. FACT: on January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. On January 21, 2025, the court granted the government's motion to dismiss the case with prejudice. Sposite was never sentenced. CHARGE ONLY: the obstruction of an official proceeding count and the remaining misdemeanors were accusations. They were never tried and never proven.
