Michael Mollo, Jr. is a 44 year old from Oak Lawn, Illinois, and his January 6 case ended the only way a case can truly end. Dismissed with prejudice. He was never convicted of anything. FACT: Federal prosecutors filed against Mollo on November 5, 2024, almost four years after January 6, 2021, and in the same week as a presidential election. FACT: He was arrested on November 7, 2024, in Walkerton, Indiana. FACT: On January 24, 2025, the court granted the government's motion to dismiss the case with prejudice. Dismissed with prejudice means it cannot be brought again. Ever. Michael Mollo, Jr. did not plead guilty. He was not tried. He was not convicted. The government walked away and the door locked behind it. CHARGE ONLY: The complaint alleged five counts, including Civil Disorder and four counts tied to entering and remaining. Every one of them is an allegation that was never proven and is now permanently gone. CHARGE ONLY: The statement of facts alleged that Mollo put his hands on an officer's hand and baton, and quoted him saying "You see what you're doing? You're on camera" and later "This is our house." Allegations in a charging affidavit are not findings of fact. No judge and no jury ever weighed a word of it. He is presumed innocent, and in his case that presumption was never overcome. Four years of waiting. Eighty days of a case. Then nothing, forever. THE CASE RECORD Case 1:24-mj-00352-MJS, U.S. District Court for the District of Columbia.
