Matthew Schmitz was inside the United States Capitol for forty one seconds. Not forty one minutes. Forty one seconds. That number comes from the government's own surveillance footage and it is in the court record of his case. FACT: Matthew Schmitz is from Lindenhurst, New York, on Long Island. FACT: According to the FBI statement of facts, security video from inside the Capitol on January 6, 2021 shows him wearing a helmet, goggles, a black face mask, and an American flag bandanna. Court documents put his total time inside the building at approximately 41 seconds. FACT: A complaint was filed against him on June 21, 2023, and Matthew Schmitz was arrested the next day, June 22, 2023, in case 23-mj-00137. FACT: He was charged with four counts. All four were misdemeanor or petty offenses. No violence charge. No assault charge. No weapon charge. No theft. No conspiracy. No property damage. FACT: He pleaded guilty to exactly one count, Entering and Remaining in a Restricted Building or Grounds. The other three charges were dismissed. FACT: On January 16, 2025, he was sentenced to three years of probation, $500 in restitution, and a $25 special assessment. No prison time. FACT: Four days later, on January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. Matthew Schmitz received a full pardon.
