Martin James Cudo is a Lakeville, Minnesota man who went to Washington with his mother and his stepfather. A family trip. He was 43 when the charges came. [FACT - Star Tribune, MPR News, December 2023] Lakeville, Minnesota. Dakota County. That is home. WHAT THE RECORD SHOWS Martin James Cudo was not charged in 2021. He was not charged in 2022. He was arrested on December 18, 2023, one week before Christmas, nearly three years after January 6. [FACT - Star Tribune; MPR News] The FBI got to him because a high school classmate saw a selfie he had posted and sent in a tip. Agents showed him the photo. He confirmed it was him. [FACT - Star Tribune; The Daily Beast] He was charged with illegal entry of the Capitol, including a count of entering with intent to impede or disrupt the U.S. House of Representatives. [CHARGE ONLY - Star Tribune; MPR News. Allegations only. He is presumed innocent.] At the time he was charged, the U.S. Supreme Court had already agreed to review the obstruction theory the government was using against Cudo and more than 300 other defendants. [FACT - MPR News, December 19 2023] That is the Fischer question. The government charged him on a theory the Supreme Court was actively examining. Three years of silence. Then a knock in December. That is what this looked like from the inside. CLEMENCY The January 20, 2025 proclamation granted full pardons for offenses related to the events at or near the United States Capitol on January 6, 2021, and directed the Attorney General to move to dismiss pending indictments in that class of cases. [FACT - Federal Register 2025-01950] Martin James Cudo's case was pending and falls within the class described.
