Source: CBS Los Angeles, Huntington Beach Man Mark Simon Arrested In Capitol Riot. THEIR ACCOUNT: at that first appearance, CBS reported that Simon appeared to blurt out that he did not enter the Capitol. He said it out loud, in open court, on day one. Source: CBS Los Angeles. HOW THEY FOUND HIM. Not a tip line. Not an informant. Photographs he took on his own phone and posted himself. The criminal complaint used his own pictures. Source: CBS Los Angeles. THE CHARGES, PLAINLY. Four misdemeanor counts: entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, disorderly conduct in a Capitol building or grounds, and parading, demonstrating, or picketing in a Capitol building. No assault. No weapon. No conspiracy. No felony. FACT: Mark Steven Simon pleaded not guilty to all four counts on February 3, 2021. A plea agreement was entered August 19, 2021. On December 7, 2021 he was sentenced to 35 days of incarceration and $500 in restitution, with the term to begin no later than January 3, 2022. Source: DOJ Capitol Breach case record preserved in this archive. Thirty five days. Not thirty five months. That distinction gets lost in almost every story ever written about January 6, and it is the whole truth of this file. NEEDS AUTHENTICATION: secondary reporting lists his age as 52 at the time of sentencing. That has not been confirmed against a primary record. FACT: On January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. THE RECORD. Case 1:21-cr-67, U.S. District Court for the District of Columbia.
