Mark Mercurio is a Mecklenburg County, Virginia man. Southside Virginia, right on the Carolina line. He was 56 when the federal agents came. No charge. 2023. No charge. November 21, 2024. Arrested in Bracey, North Carolina, three years and ten months after the fact. [FACT - WSET, November 22 2024] Sixty days before the proclamation. Read that again. WHAT HE WAS CHARGED WITH Mark Mercurio was charged with two felonies, obstruction of law enforcement during civil disorder and assaulting, resisting or impeding certain officers, plus six misdemeanors covering entering and remaining in a restricted building or grounds, disorderly and disruptive conduct, engaging in physical violence in a restricted building or grounds, disorderly conduct in a Capitol building, an act of physical violence in Capitol grounds or buildings, and parading, demonstrating or picketing in a Capitol building. [CHARGE ONLY - government allegation. Never tested at trial. Mark Mercurio is presumed innocent of every count.] An allegation is an allegation. Nobody in this country loses the presumption of innocence because a press release went out. CLEMENCY On January 20, 2025, roughly two months after his arrest, the proclamation granted full pardons for offenses related to the events at or near the United States Capitol on January 6, 2021, and directed the Attorney General to move to dismiss pending indictments in that class of cases. [FACT - Federal Register 2025-01950] Mark Mercurio's case was pending and falls within the class described. [DOCUMENTED INFERENCE - individual docket disposition NEEDS AUTHENTICATION] Arrested in November. Case in the dismissal class in January. He never got a trial because the case never got that far. THE CASE RECORD Name: Mark Mercurio Court: U.S. District Court for the District of Columbia Arrested November 21, 2024 in Bracey, North Carolina. Announced November 22, 2024. There is an arrest and a charging document, and that is all the public record shows. WHAT IT DOES PROVE A 56 year old man from Mecklenburg County, Virginia was arrested on eight federal counts almost four years after January 6, and sixty days later the case fell inside the dismissal class. Show me the evidence, and show me why it took four years. This profile is unclaimed. If this is you, or your family, claiming it is free, forever.
