Landon Bryce Mitchell is a Houston, Texas man who spent about five minutes inside the Capitol taking pictures and got 27 months in a federal prison for it. Five minutes. Two years and three months. WHAT THE RECORD SHOWS [FACT] Case summaries of his file report that Mitchell and a friend entered the Capitol, walked through the Rotunda to the Senate chamber, were inside for approximately five minutes, and took pictures. [FACT] He was not charged with assaulting an officer. He was not charged with a weapon. He was not charged with destroying property. THE LEGAL FIGHT [FACT] Mitchell was arrested October 20, 2021 and indicted December 8, 2021. [FACT] He was tried and found guilty by the court on December 7, 2022 on counts that included obstruction of an official proceeding. [FACT] He was sentenced April 20, 2024 to 27 months in prison and three years of supervision, plus restitution and special assessments. He was designated to FCI Beaumont Medium in Texas. THE RECEIPT [FACT] On June 28, 2024, the Supreme Court of the United States decided Fischer v. United States and narrowed 18 U.S.C. 1512(c)(2), the obstruction of an official proceeding statute the Justice Department used against hundreds of January 6 defendants. [DOCUMENTED INFERENCE] Landon Bryce Mitchell was sentenced roughly ten weeks before the Supreme Court narrowed the statute he was convicted under. He was already in a Texas prison when the ruling came down. [FACT] On January 20, 2025 the President issued a proclamation granting full, complete and unconditional pardons to individuals convicted of offenses related to the events at or near the United States Capitol on January 6, 2021. Mitchell's conviction falls within that grant. WHAT THIS DOES NOT PROVE Nothing in this record says Landon Bryce Mitchell hurt anybody.
