Justin Stoll never went inside the Capitol. Start there, because most people reading his name assume the opposite. FACT: Prosecutors acknowledged that Stoll did not enter the Capitol building and did not damage property, and cited both as mitigating factors at his sentencing. He was on the grounds for the rally and posted videos afterward. Source: WCPO Cincinnati. FACT: Stoll was charged with transmitting a threat to injure. The charge came from a video he posted responding to an online commenter, not from any conduct at the Capitol. Source: WCPO Cincinnati. FACT: He was 42 at sentencing and is a former resident of Wilmington, Ohio. Then there is what he said when he stood up in front of the judge. THEIR ACCOUNT: Stoll told the court, "I can't change who I was. I will strive every day to not be the man I was. This experience has taught me to love everyone regardless of who they support." Source: WCPO Cincinnati, reporting from the sentencing hearing. Read that last sentence again. Love everyone regardless of who they support. A man said that in a federal courtroom, crying, with his freedom on the line. That is not a talking point. That is a person deciding who he is going to be from here forward. THE LEGAL FIGHT FACT: Arrested January 15, 2021 with an initial appearance the same day. FACT: Pleaded guilty in October 2021 to one count of transmitting a threat to injure. FACT: Sentenced July 27, 2022 by U.S. District Judge Susan Dlott to 24 months probation. No prison time. FACT: On January 20, 2025, President Trump issued clemency covering January 6 defendants. NEEDS AUTHENTICATION: Reports that Justin Stoll received an individual pardon have not been authenticated against an Office of the Pardon Attorney record here. WHAT THIS DOES NOT PROVE Justin Stoll was not convicted of anything he did at the Capitol, because he did not do anything at the Capitol. He was convicted of what he typed and filmed afterward, and he owned it in open court. Do not let anyone tell you he stormed a building. The record says otherwise.
