Justin Michael Smith is a young man from Brunswick, Ohio who was twenty years old when federal agents came looking for him over January 6. He didn't run from it. FACT: according to court records, a confidential source sent surveillance footage and social media images to the Cleveland FBI office, and agents say the footage shows Smith inside the Capitol wearing a dark hoodie, carrying a flag. Google location records allegedly placed a device tied to his name in and around the building for over an hour that day. Smith was arrested May 4, 2022, in Cleveland. FACT: he pleaded guilty to one count, Parading, Demonstrating, or Picketing in a Capitol Building. Every other charge against him was dismissed. The court gave him probation. Community service. Restitution. A young man's mistake, paid for the way the system said to pay for it. FACT: in August 2024, the court found he'd committed six probation violations and sentenced him to 120 days in jail on top of everything else. Then the record changed. FACT: Justin Michael Smith received a full and unconditional pardon from President Trump on January 20, 2025. The probation, the violations, the conviction itself, wiped clean by presidential order. Justin Smith was barely out of his teens on January 6, 2021. He's a man now, with a federal case behind him and a pardon in his file instead of a felony record. That's the record.
