Justin McAllister of Douglasville, Georgia was never convicted of anything arising out of January 6, 2021. Start there, because most coverage of him never got that far. FACT: Justin McAllister was arrested on January 29, 2024, three years after January 6. CHARGE ONLY: Federal prosecutors charged him with civil disorder and with assaulting, resisting, or impeding certain officers using a dangerous weapon, both felonies, plus four misdemeanor and petty counts. The government alleged he used two flagpoles against a police line on the West Front of the Capitol grounds, one of them carrying a flag that read "Jesus is My Savior" and "Trump is My President." Every one of those was an allegation in a charging document. None of it was ever presented to a jury and none of it was ever proven. FACT: Justin McAllister pleaded NOT GUILTY to all charges. He never took a deal. FACT: A jury trial was set for April 7, 2025. He was preparing to make the government prove it. FACT: On January 22, 2025, the court granted the government motion to dismiss the case with prejudice. With prejudice is the end of the road. The case cannot be refiled. Justin McAllister was never tried, never convicted, and never sentenced. The presumption of innocence he carried into that courtroom was never overcome, and under American law he leaves it exactly as innocent as he walked in. FACT: On January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. The dismissal in this case followed two days later.
