John Maron Nassif is a Florida man from Chuluota, out in Seminole County, and his name is now printed in the federal law books. Not many people can say that. Most defendants take the deal and disappear. John Nassif did not. Here is what the record shows. FACT: Nassif was arrested May 10, 2021 and had his initial appearance May 17, 2021. FACT: An information was filed June 22, 2021 charging misdemeanors: knowingly entering or remaining in a restricted building without lawful authority, and violent entry and disorderly conduct on Capitol grounds. FACT: He pleaded not guilty at arraignment. FACT: He went to a bench trial on December 19, 2022. FACT: On April 27, 2023 he was sentenced to seven months of incarceration and twelve months of supervised release, plus special assessments and $500 restitution. He made them prove it. He did not plead out. Then he took it up the ladder. FACT: Nassif appealed to the United States Court of Appeals for the District of Columbia Circuit, arguing that the federal parading and picketing statute could not be squared with the First Amendment. FACT: The D.C. Circuit decided United States v. Nassif, No. 23-3069, on April 9, 2024. NEEDS AUTHENTICATION: Press reporting states the Supreme Court later declined to take up his challenge. Understand what that means. A man from Chuluota, Florida forced a published federal appellate opinion out of the D.C. Circuit on a First Amendment question. Win or lose, United States v. Nassif is now a case every lawyer arguing that question has to read. John Maron Nassif made law.
