CBS Los Angeles, the Press Democrat, NBC News, and the Southern California Record all identified him as a Santa Ana man. FACT: He was not arrested in the first wave. He was arrested August 26, 2021, more than seven months after January 6, and he was indicted February 9, 2022. HIS FIGHT FACT: Brown was convicted at trial on December 6, 2022 in the U.S. District Court for the District of Columbia. The Southern California Record reported he was among the first defendants convicted of assaulting police officers on January 6. FACT: He was sentenced April 28, 2023 to 54 months, roughly four and a half years. The Justice Department, NBC News, and CBS Los Angeles all reported the sentence. United States v. Brown — D.C. Circuit opinion in Peter Schwartz appeal

Published 43-page D.C. Circuit opinion, 125 F.4th 1186, vacating Schwartz’s § 1512(c)(2) conviction, remanding for resentencing, and holding that compelling him to unlock his cellphone violated the Fifth Amendment. The court directed count-specific harmless-error review and denied the remaining appellate claims.
