Jason Brian Barrett is a 49 year old Horry County man from Longs, South Carolina, up the road from Myrtle Beach. He was never convicted of anything. The government dismissed his case with prejudice. No trial, no plea, no sentence, no prison. THE LEGAL FIGHT. FACT: Jason Brian Barrett was arrested on August 28, 2024 in Myrtle Beach, more than three and a half years after January 6, 2021. FACT: he was charged in the U.S. District Court for the District of Columbia with Assaulting, Resisting, or Impeding Certain Officers, Obstruction of Law Enforcement during Civil Disorder, Entering and Remaining in a Restricted Building or Grounds, Disorderly and Disruptive Conduct in a Restricted Building or Grounds, Engaging in Physical Violence in a Restricted Building or Grounds, and Disorderly Conduct in a Capitol Building. FACT: he appeared before Judge G. Michael Harvey in federal court in Florence, South Carolina and was released on a $20,000 bond. FACT: his release conditions were no out of state travel without Probation Office permission, no firearm possession and no excessive alcohol. He was not detained. FACT: he was granted a speedy trial. FACT: on January 22, 2025, the court granted the government's motion to DISMISS THE CASE WITH PREJUDICE. It is over and it cannot come back. CHARGE ONLY: every allegation against Jason Brian Barrett came from a criminal complaint. None of it was ever proven at trial. He never pleaded guilty to any of it. He is presumed innocent and the record ends with a dismissal, not a conviction. DOCUMENTED INFERENCE: the FBI stated it identified Barrett through social media posts and clothing seen in footage, described in filings as a dark green hoodie, a brown jacket, a white and blue baseball cap, sunglasses and work gloves. WHAT THIS DOES NOT PROVE: nothing against this Longs, South Carolina man was ever proven. Not one count.
