There is no allegation of violence, no assault, no weapon, no theft, no conspiracy, and no property damage anywhere in his charging document. FACT: He pleaded guilty to two of them: Disorderly Conduct in a Capitol Building or Grounds, and Parading, Picketing, and Demonstrating in a Capitol Building or Grounds. Sentencing was calendared for April 21, 2025. FACT: He was never sentenced. On January 21, 2025, the court granted the government motion to dismiss the case with prejudice. What that means in plain English: with prejudice is the strongest form of dismissal there is. The case is closed and it cannot be brought again. James Flint-Smith walked out of that courthouse with no sentence, no supervision, and no restitution order. FACT: On January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. The dismissal in this case followed the next day.
