FACT: On June 16, 2023, James Roe Cleary voluntarily appeared at the Waterford Police Department and turned himself in. Nobody kicked a door. Nobody staged a dawn raid with cameras rolling. He went in on his own two feet. FACT: He was 56 years old. The FBI investigation into him began in June 2022 after a coworker called in a tip. He was the ninth Connecticut resident charged federally in connection with January 6, 2021. CHARGE ONLY: The indictment carried one felony count of obstruction of law enforcement during a civil disorder plus six misdemeanor counts including simple assault, unlawful entry, disorderly conduct, and physical violence in a restricted building. Prosecutors described video near the Lower West Terrace tunnel. James Roe Cleary never went to trial on any of it. He is presumed innocent of every allegation, and every one of them is an allegation. FACT: He was arrested on the indictment in October 2024, nearly four years after the day in question. FACT: On January 20, 2025, President Trump issued clemency covering January 6 cases, including directing the Attorney General to dismiss pending indictments. Cleary was still awaiting trial.
