Gary Francis Smith
Pardoned January 6 defendant
Gary Francis Smith is a 71 year old man from Casco, Michigan. He went to Washington with his sister. He was inside the Capitol for about four minutes. The federal government spent the next two years building a case against him. FACT, per court documents summarized in the NPR January 6 archive: Gary Smith of Casco, Michigan went to the U.S. Capitol with his sister, Deborah Kuecken. The two of them entered through the Rotunda doors, stayed inside roughly four minutes, and walked back out. Four minutes. FACT: the FBI received a tip about the pair. Agents served search warrants on Verizon and pulled cell site records placing his phone in an area that included the Capitol. They compared photographs from his Facebook page against images from that day, where he was wearing a dark coat, a hoodie, and a Detroit Tigers ball cap. And this is the line in the Gary Francis Smith record that ought to stop you cold. FACT: his own son identified him and his aunt in the images from the Capitol. Read that again. The government built its identification on a son naming his 71 year old father. Gary Francis Smith and his sister were arrested in October 2022, nearly two years after January 6. THE LEGAL FIGHT FACT: Smith pleaded guilty to one charge, parading, demonstrating, or picketing in a Capitol building. That is a petty offense. The other three charges were dismissed. FACT: on June 9, 2023, he was sentenced to 36 months of probation, 30 days of location monitoring, $500 in restitution, a $10 special assessment, and 60 hours of community service. Three years of probation for four minutes and a petty offense, at 71 years old. FACT: on January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. Gary Francis Smith received a full pardon. NEEDS AUTHENTICATION: this archive has found no reporting on Smith's trade, his service, or his life in Casco and St. Clair County, Michigan before any of this. If you know the man, the record has room for him. THE CASE RECORD Case 1:22-mj-225, U.S. District Court for the District of Columbia. Complaint filed October 21, 2022. Arrested October 27, 2022.
