Francis Joseph Vitollo is a 68-year-old man from Coeymans, New York, a small Hudson River town in Albany County with fewer than 8,000 people in it. Sixty-eight years old. Small town. Federal agents knocked on his door three years and four months after January 6, 2021. THE MAN FACT: Francis Joseph Vitollo of Coeymans, New York was 68 at the time of his arrest. Think about the arithmetic. A man in his late sixties, in a Hudson Valley town most New Yorkers could not find on a map, charged with four misdemeanors more than three years after the fact. THE CHARGES, AND ONLY THE CHARGES CHARGE ONLY: Entering and Remaining in a Restricted Building or Grounds; Disorderly and Disruptive Conduct in a Restricted Building or Grounds; Disorderly Conduct in a Capitol Building or Grounds; Parading, Demonstrating, or Picketing in a Capitol Building. FACT: Every one of those counts is a misdemeanor. There is no allegation in the charging document of assault, of a weapon, or of property destruction. FACT: Francis Vitollo pleaded NOT GUILTY to all charges. A jury trial was set for April 28, 2025. HOW IT ENDED FACT: On January 21, 2025, the court granted the government motion to dismiss the case WITH PREJUDICE. With prejudice is the strongest form of dismissal there is. The government cannot bring it back. FACT: On January 20, 2025, President Trump granted clemency covering the January 6 prosecutions. FACT: Francis Joseph Vitollo was never convicted. He was never sentenced. He never went to trial. WHAT THIS DOES NOT PROVE It does not prove what happened on any sidewalk or in any hallway that day.
