Eliel B. Rosa is a civics teacher in Midland, Texas. He fled political persecution in Brazil, won asylum in America, and then walked into an FBI office on his own two feet three days after January 6, because nobody had come looking for him yet. Read that again. Nobody was looking for him. He went in anyway. FACT: Eliel Rosa and his wife left Brazil in 2016 after political persecution. They were granted asylum in the United States in October 2018 and were pursuing American citizenship. FACT: he works as a civics teacher. A civics teacher. In Midland, Texas. FACT: three days after January 6, before he had been publicly identified as a suspect, Rosa voluntarily went to the FBI office near his home and told them he had been there. The sentencing judge called that unprecedented. Think about what kind of man does that. He was not caught. He was not on a wanted poster. He turned himself in because he teaches other people's kids what a citizen is supposed to do. THEIR ACCOUNT: writing to the court, Rosa quoted the Federalist Papers and said he had surrendered to the lower portions of human nature. That is a man taking responsibility in the language of the founding documents he teaches for a living. FACT: U.S. District Judge Trevor McFadden told him, "Sir, you participated in a shameful event, a national embarrassment that made us all feel less safe." The court said its piece. Rosa took it standing up. THE LEGAL FIGHT FACT: arrested January 13, 2021. Indicted February 3, 2021. Arraigned February 16, 2021 and pleaded not guilty to all counts. FACT: plea agreement entered July 29, 2021. He pleaded guilty to count 5 of the indictment. FACT: on October 12, 2021 he was sentenced to twelve months of probation, 100 hours of community service, and $500 restitution. No jail. No home confinement. FACT: the misdemeanor conviction put his citizenship application at risk under the good moral character requirement. A man who fled a government that persecuted him for his politics stood to lose his shot at American citizenship over a misdemeanor. FACT: on January 20, 2025, President Trump granted clemency covering the January 6 prosecutions.
