Derek Cooper Gunby is from Anderson, South Carolina, in the Upstate. He did not take a plea deal. He pleaded not guilty and took his case to a jury, which found him guilty on all counts in November 2023. But the record did not end there. In August 2024, the obstruction conviction against Derek Gunby was thrown out. He was sentenced in December 2024 to 60 days, but before his surrender date ever arrived, President Trump's January 20, 2025 pardon reached him first. Derek Gunby never spent a day in prison over January 6. He has spoken publicly about it since, telling Fox Carolina he is still after full exoneration and that the pardon "will do until that."
