David Mullsteff is a Glen Allen, Virginia man, age 61, who attended President Trump's rally at the Ellipse on January 6, 2021, before making his way to the Capitol. FACT: According to federal court records, Mullsteff witnessed broken windows and heard the commotion of the crowd, then continued to the Upper West Terrace and entered the Capitol through the breached Senate Wing door. He took photos and video inside. (Source: plea agreement, USCOURTS-dcd-1_24-cr-00330) FACT: He was arrested June 3, 2024, more than three years after January 6, and pleaded guilty to one count of Entering and Remaining in a Restricted Building or Grounds. (Source: NPR January 6 Defendants Database) CORRECTION: This profile previously stated Mullsteff was sentenced to 36 months of probation, 60 days of home detention, a $5,000 fine, and $500 restitution. That was wrong. Those numbers came from the government's recommended range inside the plea agreement, not from an actual sentence. The record shows he was never sentenced. Sentencing had been set for January 24, 2025. Two days after the January 20, 2025 clemency proclamation, on January 22, 2025, the court dismissed his case without prejudice, before that sentencing hearing ever happened.
