David Scott Kuntz is a southern Indiana man out of Elizabeth, a small town in Harrison County on the Ohio River. The government waited three years and two months to come get him. THE LEGAL FIGHT [FACT] Kuntz was 53 when he was arrested in March 2024. He was arrested and charged in the Southern District of Indiana for conduct alleged on January 6, 2021. That is more than three years after the day. [FACT] He was charged with obstruction of an official proceeding, a felony, plus misdemeanor counts of entering and remaining in a restricted building and disorderly conduct. [FACT] WHAS11 reported that Kuntz later pleaded guilty for his role. THE RECEIPT [FACT] On June 28, 2024, three months after David Scott Kuntz was charged, the Supreme Court decided Fischer v. United States and narrowed 18 U.S.C. 1512(c)(2), the obstruction of an official proceeding statute the Justice Department had used against hundreds of January 6 defendants. [DOCUMENTED INFERENCE] Kuntz was charged with that felony in March 2024. The Supreme Court narrowed the statute in June 2024. The government brought the charge three years late and three months before the law under it changed. [FACT] On January 20, 2025 the President issued a proclamation granting full, complete and unconditional pardons to individuals convicted of offenses related to the events at or near the United States Capitol on January 6, 2021, and directing dismissal of pending indictments in those cases. Kuntz's case falls within that grant. WHAT THIS DOES NOT PROVE [CHARGE ONLY] The allegations in the complaint about what Kuntz said and posted are the government's allegations, filed to justify an arrest. Kuntz was not charged with assaulting an officer. He was not charged with using a weapon. He was not charged with destroying property. A charge is a charge, and he is presumed innocent of anything not established in court.
