Bryan Emmanuel Bustos
Pardoned January 6 defendant
Documented editorial-use imageBryan Emmanuel Bustos is from Long Beach, California. He flew to Washington, D.C., with his brother and co-defendant, Alexis Bustos, on Jan. 3, 2021, and the two returned home to California on Jan. 8 (FACT, per Long Beach news coverage and court filings). What the record shows: prosecutors said Bryan entered the Capitol about 2:40 p.m. on Jan. 6 carrying an American flag, walked to the Rotunda, and later posted a photo of himself inside on Instagram — which the FBI used, along with his driver's license and security footage, to identify him. He was charged with four misdemeanor counts: entering and remaining in a restricted building, disorderly and disruptive conduct, disorderly conduct in a Capitol building, and parading or demonstrating in a Capitol building. He pleaded guilty on November 7, 2022. Plain English: these were misdemeanor counts, not charges of violence, and Bustos resolved his case with a guilty plea. President Trump's January 20, 2025 clemency covered Jan. 6 defendants like him. (Note: Bryan Bustos of Long Beach should not be confused with other Jan. 6 defendants who have similar-sounding names.) Case record: Case No. — 1:22-cr-16. Court — U.S. District Court for the District of Columbia. Complaint — Sept. 29, 2021. Arrested — Nov. 17, 2021. Pleaded guilty — Nov. 7, 2022.
