Brian Holmes spent more than six years answering the call as a firefighter and EMT for Arlington County, Virginia, while calling Martinsburg, West Virginia home. That is who he was before January 6, 2021 ever became a headline. A man who showed up on shift. A man neighbors called when the smoke alarm went off or the ambulance was needed at 3 a.m. Brian Holmes was not working that day. He was off duty when he went to Washington, D.C. Federal prosecutors say he was later seen in the crowd at the Capitol and charged him with civil disorder and assaulting, resisting, or impeding officers, along with several restricted-grounds counts. He was arrested on September 13, 2024, more than three and a half years after the events in question, and pleaded not guilty to every charge. NEEDS AUTHENTICATION: no video, trial record, or admission has been published on this record beyond the federal complaint itself. Here is what the record shows plain. Holmes kept working the job after January 6. He returned to duty January 11, 2021. He wore the uniform for Arlington County for years afterward. That is not something the government disputes. Then, on January 20, 2025, President Trump signed a proclamation granting clemency to the January 6 defendants still facing charges. On January 23, 2025, the court granted the government's motion to dismiss Brian Holmes's case with prejudice. Not a conviction. Not a guilty plea. A dismissal, with prejudice, meaning the case cannot be brought again. This is the record. Same country, one case closed by executive clemency before a jury ever heard it. Ryan Nichols has walked this road. Charged. Jailed. Sentenced. Pardoned January 20, 2025. He knows what it costs a family when the government spends years building a case that ends in dismissal. He knows the men and women behind these case files are more than a docket number.
