Barry Allen Toth is a Michigan man from Standish, up in the northeastern Lower Peninsula. On January 6, 2021, Barry entered the Capitol and spent roughly half an hour inside before leaving. He was not accused of assaulting officers or destroying property — the government's case rested on his presence in the building that day. The legal fight: Barry Allen Toth was arrested in February 2024, three years after that day, and charged with obstruction of an official proceeding and several misdemeanors. He was released to return home to Michigan while his case proceeded. On January 20, 2025, President Trump granted clemency to January 6 defendants.
