The record, so far

Andy Steven Oliva-Lopez of Milwaukie, Oregon has one of the strangest footnotes in the entire January 6 docket: before he was ever charged, his photo from that day was used in a Biden campaign ad (NBC News; The Hill, 1/2024). FACT: He drove across the country from Oregon at age 27 to attend the "Stop the Steal" rally (Willamette Week; OPB). FACT: A Getty photographer's widely republished image showed him in a blue plaid shirt, helmet, and gas mask discharging orange spray — and that image circulated in national media, including the campaign ad, for three years before the FBI arrested him in January 2024 (NBC News). FACT: He did not force a trial. In September 2024 he pleaded guilty and admitted the conduct — spraying officers with bear spray at police lines, affecting at least three officers (NBC News; KOIN; OPB, 9/17/24). FACT: His sentencing was set for January 17, 2025. Three days later, on January 20, 2025, President Trump's January 6 clemency proclamation covered the January 6 cases (NBC News; whitehouse.gov). The charges were serious and he admitted them — that is the record. He also owned it in open court instead of hiding from a photo the whole country had already seen. --- CASE RECORD U.S. District Court for the District of Columbia Arrested 1/2024 in Oregon.
